Private building law / developer law (new building / old building):

We have pursued all of these cases both in and out of court.

  • Delay in delivery by the developer:

    • Compensation for damages caused by default (commission interest, replacement rent, storage costs, loan interest and repayment?) and contractual penalty
    • Enforcement of the warranty for material defects and damages against the developer (including construction defects, botched construction, underperformance, independent evidentiary proceedings? Insolvency of the craftsman’s company?)
    • Enforcement of a warranty for material defects and damages against the seller of a private property (e.g. fraudulent misrepresentation, moisture/mould, water damage, marten infestation, asbestos?)
  • Contesting and rescission of notarial purchase contracts in the event of a lack of guaranteed property or fraudulent misrepresentation (real estate transfer tax, prepayment penalty, agent and notary fees?)

  • Negotiation of purchase price reduction and damages according to the Harvard concept

    • Application for independent evidence preservation procedure according to §§ 485 ff. ZPO
  • Renovation of old buildings: Enforcement of liability for defects and damages against the craft company

    • Examination of notarial property purchase agreements (warranty exclusion effective? Notary liability?)
  • Defense against unfounded defect attacks by the buyer and claims for damages by non-contractual buyers
